1. Agreement
These Terms of Service (“Terms of Service”) are a legal agreement between you and Madhusudan, an individual based in Bangalore, Karnataka, India, who owns and operates DiffSight (“DiffSight”, “we”, “us” or “our”).
They govern your use of https://diffsight.com, https://www.diffsight.com and the text and file comparison tools on them (together, the “Service”).
The following documents form part of these Terms of Service:
- our Terms of Use,
- our Privacy Policy,
- our Cookie Policy, and
- our Disclaimer.
Together, these are the “Terms”. If they conflict, these Terms of Service take priority.
By accessing or using the Service, you agree to the Terms. If you do not agree, do not use the Service.
2. Eligibility
You may use the Service only if you can form a legally binding contract under the law that applies to you.
If you are under 18, or under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian. That parent or guardian accepts these Terms on your behalf.
If you use the Service on behalf of an organisation, you confirm that you have authority to accept these Terms for it.
3. The Service
DiffSight provides free, browser-based tools for comparing text, code and files and highlighting the differences between them.
Comparisons are processed locally in your web browser. The content you compare is not uploaded to or stored on our servers.
No account or registration is required.
We may add, change or remove features at any time.
4. Your content
Ownership. You keep all rights to the text and files you compare (“Your Content”). Because Your Content is processed only on your device, we receive no copy of it and no licence to it.
Your responsibility. You are solely responsible for Your Content. This includes making sure you have the right to use it and that comparing it does not break any law, contract or confidentiality obligation.
Back-ups. We do not store Your Content and cannot recover it. Keep your own copies of anything important.
5. Fees
The Service is currently free.
If we introduce paid features in the future, we will tell you the price and terms before you buy. You will never be charged without your explicit agreement.
6. Advertising
The Service is supported by advertising, including ads served by Google AdSense.
Any dealings you have with advertisers, including purchases, are solely between you and the advertiser. We are not responsible for advertisers’ products, services or claims.
7. Acceptable use
You must use the Service in line with our Terms of Use, which set out what is and is not allowed.
8. Intellectual property
The Service belongs to Madhusudan or its licensors. This includes its software, design, text, graphics, logos and the name “DiffSight”, which are protected by copyright, trademark and other laws.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for personal or internal business purposes, in accordance with these Terms.
Some components of the Service are open-source software. Those components are licensed under their own licences, and nothing in these Terms limits your rights under them.
9. Feedback
If you send us suggestions or feedback, we may use them freely. We have no obligation to you, and you will not be entitled to any payment.
10. Availability and changes to the Service
We try to keep the Service available, but we do not guarantee that it will be uninterrupted, timely or error-free.
We may modify, suspend or discontinue the Service, or any part of it, at any time, with or without notice. We are not liable to you for doing so.
The Service depends on your browser and device. Some features may not work on every browser, or with very large files.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. This includes, without limitation, warranties of:
- accuracy,
- completeness,
- merchantability,
- fitness for a particular purpose, and
- non-infringement.
We do not warrant that comparison results will be accurate or complete, or suitable for any particular purpose. Our Disclaimer explains this further.
12. Limitation of liability
12.1 To the fullest extent permitted by law, neither DiffSight nor its owner will be liable for any of the following arising from or related to your use of, or inability to use, the Service:
- indirect, incidental, special, consequential, exemplary or punitive damages;
- loss of data, profits, revenue, goodwill or business opportunity.
This applies even if we were advised that such damages were possible.
12.2 To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed INR 1,000 (one thousand Indian Rupees).
12.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. This includes liability for fraud, wilful misconduct, or death or personal injury caused by negligence. It also includes any mandatory rights you have as a consumer where you live.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless DiffSight and its owner from any claims, losses, damages, liabilities and expenses (including reasonable legal fees) that arise from:
- your breach of these Terms;
- your misuse of the Service; or
- Your Content infringing anyone’s rights.
14. Suspension and termination
We may restrict, suspend or block your access to the Service, without notice, if:
- we reasonably believe you have breached these Terms;
- we reasonably believe you have used the Service unlawfully; or
- this is needed to protect the Service or other users.
You may stop using the Service at any time.
Section 4, Section 8, Section 9 and Section 11 to Section 18 continue to apply after termination.
15. Governing law and jurisdiction
These Terms are governed by the laws of India.
Subject to Section 16, the courts at Bangalore, Karnataka, India have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service.
